Pre-Trial Motions Heard In Lane County Commissioners Case
Attorneys for three Lane County commissioners accused of conducting business in secret meetings were in court Tuesday.
The attorneys for commissioners Rob Handy, Peter Sorenson, and Bill Fleenor, have subpoenaed the private investigator hired by the prosecuting attorney.
They want a list of everyone he's talked to in the case and everyone the prosecution plans to use as a witness.
The attorney for the prosecution filed a motion to quash the subpoena.
He says there is no legal basis for the subpoena and handing over the names would make the potential witnesses vulnerable to intimidation.
Coos County Judge Michael Gillespie allowed the motion, saying that in Oregon, the defense is not entitled to know who is going to be a witness.
The trial is set for December 8th.
