Oregon Medical Marijuana Patient Fights Charge of Illegal Pot Possession

A man who brought his medical marijuana into the courthouse in Springfield, Oregon last month will fight a charge of illegal pot possession in court. Paul McClain showed up at the courthouse on February 11th with a backpack holding a small amount of pot. Springfield Police searched his bag, as they do all entrants. McClain was cited for possession even though he has a medical marijuana card. Eugene attorney Brian Michaels is representing McClain. He said the law should exempt McClain from Oregon's criminal marijuana laws. “It carves out an exception for the use and growing and transportation of marijuana for those within the protection of the Oregon Medical Marijuana Act," he said.Michaels says Oregon's criminal laws regarding marijuana are complicated and so are its medical marijuana laws. The trial date is April 22nd.
