Judge Upholds WA's Lethal Injection Protocol
Washington's Attorney General plans to ask the state Supreme Court to lift a stay of execution for death row inmate Cal Coburn Brown.
That's after a lower court ruled Friday that Washington's lethal injection protocols are constitutional. Olympia Correspondent Austin Jenkins reports.
Three condemned inmates – including Brown – filed suit.
Their claim?
Washington has inadequate safeguards in place to ensure a painless lethal injection. Now in an eight-page ruling, Superior Court Judge Chris Wickham rejected the condemned men's argument.
Sara Olson tried the case for the Attorney General. She says the state will now push ahead with the execution of Cal Brown whose life was spared at the last minute because of this lawsuit.
Sara Olson: “In light of the court's well-reasoned, thorough decision we will likely move to lift that stay and that motion would be made to the Washington Supreme Court.”
But lawyers for the death row inmates also plan to go to the state Supreme Court. Their appeal could further delay any executions in Washington.
Brown was convicted in 1991 of the rape, torture and murder of Holly Washa.
