Clackamas Settles Kaady Lawsuit For $1 Million

The family of Fouad Kaady has agreed to settle a lawsuit with Clackamas County for $1 million. In 2005, police found Fouad Kaady, naked, bleeding, and on fire, after having caused a car accident. In the ensuing confrontation, two lawmen shot Kaady to death. The Kaady family sued several police and government agencies involved. A suit against the city of Sandy was settled last summer.Michael Patterson is the attorney representing Clackamas County.  He called the  settlement a business decision. “All that I can say is that we had evaluated case as having a potential exposure of up to one million dollars. Plaintiff’s Counsel had indicated they wanted anywhere from $5 to $20 million," he said.Patterson says the county then made a limited-time offer, which the plaintiffs accepted.Under the terms, the county admits to no wrongdoing. Deputy David Willard, one of the officers involved, is dismissed from the claim, and shielded from further lawsuits.An attorney for the Kaady family could not be reached for comment.
