Clackamas Settles Kaady Lawsuit For $1 Million

The family of Fouad Kaady has agreed to settle a lawsuit with Clackamas County for $1 million. In 2005, police found Fouad Kaady, naked, bleeding, and on fire, after having caused a car accident. In the ensuing confrontation, two lawmen shot Kaady to death. The Kaady family sued several police and government agencies involved. A suit against the city of Sandy was settled last summer.Michael Patterson is the attorney representing Clackamas County.  He called the  settlement a business decision. “All that I can say is that we had evaluated case as having a potential exposure of up to one million dollars. Plaintiff’s Counsel had indicated they wanted anywhere from $5 to $20 million," he said.Patterson says the county then made a limited-time offer, which the plaintiffs accepted.Under the terms, the county admits to no wrongdoing. Deputy David Willard, one of the officers involved, is dismissed from the claim, and shielded from further lawsuits.An attorney for the Kaady family could not be reached for comment.

The county, and indeed, the Sandy Police Department, do not NEED to admit to any wrong doing. Any sane person, knowing the detalis, could come to no conclusion, other than these officers were DEAD WRONG, and their supervisors, who retained these fools, are also DEAD WRONG! Within 28 seconds (via 911 radio log) of the officer's arrival, and locating this victim, he was DEAD! In this twenty eight seconds (start counting now) the officers said that they dismounted their vehicle, noted that the victim was "unarmed, naked, sitting crosslegged at the edge of the road, catatonic, and moaning. (he was burned over eighty percent of his body)" both officers, fearing that he might touch them, demanded that he lie, prone, on the pavement (CATATONIC, remember?) which he did not do (go figure!) the officers, fearing that he might touch them, emptied both of their tasers (darts, 50K volts!) into his back. When the taser torture ended, the victim apparently snapped out of his catatonic state enough to flee torture. The officers then shot and killed him, in the presence of paramedics and firemen, and their supervisor, and our District Attorney, could find no problem??? (how many times have you counted to 28 seconds while reading this?)

The lesson here is a simple one: If you are in a car accident, bleeding, naked and on fire, do not call the sheriff's office. You will be seen as a threat to officers and civilians alike. People who are are fire do not act rationally. And sometimes neither do the police.
