The Portland Police Bureau investigated allegations that Gore sexually attacked a massage therapist while in Oregon four years ago.

Schrunk said that contradictory evidence; conflicting witness statements; credibility issues; a lack of forensic evidence; and Gore's denials, all mean a sustainable criminal case doesn't exist.

Kohel Haver is an attorney for massage therapist Molly Hagerty.

Kohel Haver: "Of course Molly is disappointed that the district attorney has declined to prosecute, but understands their decision."

In an eight page statement, the district attorney listed deficiencies in the case. Those including the fact that Hagerty called Gore after the massage saying he should quote: "dream of redheaded women." Hagerty has red hair.

Witnesses at the hotel don't remember hearing anything unusual that night.

Schrunk says Hagerty didn't provide medical records related to the case; that she failed a polygraph test and was paid by the National Enquirer for her story.

Schrunk says Gore submitted to an interview where he said he was "completely baffled" by Hagerty's statements.
